These Terms of Use ("Terms") govern your access to and use of the website located at https://tenek.ai and the marketing services provided by Tenek LLC ("Tenek," "we," "us," or "our"). 1. Services
Tenek provides B2B growth marketing services including but not limited to:
- Paid advertising strategy and management (Meta Ads, Google Ads)
- AI-powered marketing funnel design and build
- Marketing automation using GoHighLevel (GHL)
- CRM setup, pipeline management, and lead nurturing
- Landing page and funnel copywriting and design
- SMS and email marketing automation
- Strategy consulting and performance reporting
The specific scope of services will be outlined in a separate service agreement or statement of work between Tenek and each client.
2. Eligibility
You must be at least 18 years of age and have the legal authority to enter into a binding contract to use our services or website. By using our website, you represent that you meet these requirements.
3. Communications and SMS Messaging
3.1 Consent to Receive Communications
By submitting a contact form, booking a call, or otherwise engaging with Tenek through our website or marketing campaigns, you consent to receive communications from Tenek including:
- SMS text messages regarding your inquiry, appointment reminders, and service updates
- Email communications regarding your inquiry and Tenek's services
- Follow-up calls from our team
3.2 SMS Terms (A2P 10DLC Compliance)
Tenek uses automated SMS messaging through registered Application-to-Person (A2P) channels to communicate with prospects and clients. By opting in to SMS communications, you agree to the following:
- Message frequency: Message frequency varies. You may receive up to 5 messages per week depending on your inquiry and engagement status.
- Message and data rates: Standard message and data rates may apply based on your mobile carrier plan.
- Opt-out: Reply STOP at any time to unsubscribe from SMS messages. You will receive a one-time confirmation message and no further messages will be sent.
- Help: Reply HELP for assistance or contact us at admin@tenek.ai.
- Carriers: Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, Sprint, and other major US carriers. Carriers are not liable for delayed or undelivered messages.
- No purchase required: Consent to receive SMS messages is not a condition of purchasing any services from Tenek.
3.3 Prohibited Uses of Communications
You agree not to use any communication channel provided by Tenek to send unlawful, harassing, defamatory, or spam messages. Tenek reserves the right to terminate communications with any individual who violates these terms.
4. Intellectual Property
All content on our website including text, graphics, logos, images, and software is the property of Tenek or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.
5. Client Responsibilities
If you engage Tenek's services as a client, you agree to:
- Provide accurate and complete information required for us to perform the services
- Grant Tenek the necessary access to ad accounts, CRMs, and other platforms required to deliver services
- Ensure all advertising content, offers, and business claims comply with applicable laws and platform policies
- Maintain compliance with Meta's Terms of Service, Google's Advertising Policies, and all applicable telemarketing and SMS laws
- Pay all fees on time as outlined in your service agreement
6. Payment Terms
Payment terms, rates, and billing schedules are governed by the service agreement between Tenek and the client. All fees are non-refundable unless otherwise stated in writing. Tenek reserves the right to suspend services for accounts with outstanding balances.
7. Disclaimer of Warranties
Tenek's website and services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that our website will be uninterrupted or error-free. While we work diligently to produce positive results for our clients, Tenek does not guarantee specific marketing outcomes, revenue targets, or return on ad spend.
8. Limitation of Liability
To the fullest extent permitted by law, Tenek LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, even if Tenek has been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or our services shall not exceed the total fees paid by you to Tenek in the three (3) months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Tenek, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any applicable law or third-party rights.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
11. Compliance with Platform Policies
Tenek operates advertising campaigns on behalf of clients across third-party platforms including Meta and Google. All campaigns are subject to the respective platform's advertising policies. Tenek is not responsible for account suspensions, ad disapprovals, or policy violations caused by client-provided content or business practices that violate platform terms.
For SMS communications, Tenek complies with:
- The Telephone Consumer Protection Act (TCPA)
- The CAN-SPAM Act
- CTIA Messaging Principles and Best Practices
- A2P 10DLC registration requirements for business messaging in the United States
12. Modifications to Terms
Tenek reserves the right to update these Terms at any time. We will notify you of material changes by updating the effective date and, where appropriate, by providing notice via email or our website. Your continued use of our website or services following any changes constitutes your acceptance of the revised Terms.
13. Termination
Tenek reserves the right to suspend or terminate your access to our website or services at any time, with or without cause, and with or without notice. Upon termination, all provisions of these Terms that by their nature should survive will survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14. Entire Agreement
These Terms, together with our Privacy Policy and any applicable service agreement, constitute the entire agreement between you and Tenek with respect to your use of our website and services, and supersede all prior or contemporaneous understandings regarding such subject matter.
